1. Introduction
Welcome to MindCore ("App"), a mobile application developed by CS TECHNOLOGIES, LDA ("Company," "we," "our," or "us"). By downloading, installing, or using our App, you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the App.
These Terms constitute a legally binding agreement between you and CS TECHNOLOGIES, LDA. Please read them carefully before using MindCore.
2. Eligibility
You must be at least 16 years old to use MindCore. By using the App, you represent and warrant that:
You are at least 16 years of age
You have the legal capacity to enter into a binding agreement
Your use of the App does not violate any applicable law or regulation
If you are between 16 and 18 years of age, you confirm that you have reviewed these Terms with a parent or legal guardian and that they consent to your use of the App.
3. Account Registration & Security
To access certain features of MindCore, you may be required to create an account by providing a valid email address. When creating and using your account:
You agree to provide accurate, current, and complete information
You are responsible for maintaining the confidentiality of your account credentials
You are responsible for all activities that occur under your account
You agree to notify us immediately of any unauthorised use of your account at legal@mindcoreapp.com
We reserve the right to suspend or disable your account if we reasonably believe it has been compromised or is being used in violation of these Terms.
4. User Responsibilities
By using MindCore, you agree that you will not:
Use the App for any unlawful purpose or in violation of any applicable laws or regulations
Upload, post, or share content that is harmful, offensive, defamatory, or illegal
Attempt to hack, disrupt, reverse-engineer, decompile, or disassemble any part of the App
Interfere with the security, integrity, or performance of the App
Violate any third-party rights, including intellectual property rights
Use the App in any manner that could damage, disable, or impair our servers or networks
5. Intellectual Property
MindCore and all associated content, features, trademarks, logos, and designs are owned by CS TECHNOLOGIES, LDA and are protected by applicable intellectual property laws, including copyright, trademark, and patent laws.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use MindCore for your personal, non-commercial purposes.
You may not copy, modify, distribute, sell, lease, or create derivative works from any part of the App without our prior written permission.
6. Subscription & Payments
6.1 Subscription Plans
Some features of MindCore require a paid subscription (MindCore Premium). Subscription plans and pricing are displayed within the App. Payments are processed through the platform’s payment system (Apple App Store or Google Play) or third-party payment processors (e.g., RevenueCat).
6.2 Auto-Renewal
Subscriptions automatically renew at the end of each billing period (monthly or annually) unless you cancel before the renewal date. You will be charged the then-current subscription price upon renewal. You can manage and cancel your subscription through your device’s app store settings (Apple App Store or Google Play Store).
6.3 Refunds
Refund policies are subject to the terms of the platform through which you purchased the subscription (Apple App Store or Google Play Store). Please refer to the applicable app store’s refund policy for details.
6.4 Right of Withdrawal (EU/EEA Users)
If you are a consumer in the European Union or European Economic Area, you may have a 14-day right of withdrawal from the date of purchase of a subscription under the Consumer Rights Directive (2011/83/EU). Since all MindCore subscriptions are purchased and managed through the Apple App Store or Google Play Store, the withdrawal and refund process is handled by the respective app store in accordance with their terms.
To request a refund or exercise your right of withdrawal, please use the refund mechanisms provided by the Apple App Store or Google Play Store. If you need further assistance, you may also contact us at legal@mindcoreapp.com.
7. Data Collection & Privacy
By using MindCore, you agree to our Privacy Policy, which outlines how we collect, use, and store your data. Key points:
We do not sell personal data. We use third-party services such as Firebase, RevenueCat, and Expo for app functionality.
All personal notes, journal entries, mood logs, and thought tune-up submissions are stored locally on your device only and are never transmitted to our servers.
If you choose to enable iCloud synchronisation, your on-device data will be stored in your personal iCloud account under Apple’s privacy policy. CS TECHNOLOGIES, LDA does not have access to this data.
If you do not use iCloud synchronisation, we cannot recover your data if you uninstall the App, change your device, or experience device failure. We recommend regularly backing up your device if you wish to retain your data.
8. Disclaimer of Warranties
MindCore is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, CS TECHNOLOGIES, LDA disclaims all warranties, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.
For EU/EEA consumers: Nothing in these Terms affects your statutory rights as a consumer under applicable EU and national consumer protection laws. Under Directive (EU) 2019/770, if the App has a significant defect that prevents it from functioning as described, you may be entitled to have it brought into conformity or, where the defect is not remedied, to a proportionate reduction in price or contract termination. This does not apply to minor imperfections, occasional bugs, or temporary interruptions, which are inherent to all software.
9. Limitation of Liability
To the maximum extent permitted by applicable law, CS TECHNOLOGIES, LDA shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the App, including but not limited to loss of data, loss of profits, or business interruption.
Our total aggregate liability under these Terms shall not exceed the total amount you have paid to us for MindCore Premium services in the 12 months preceding the claim.
Mandatory legal protections: The limitations above do not apply to any liability that cannot be excluded or limited under applicable law. This includes, where required by law: liability for fraud or fraudulent misrepresentation, liability for personal injury caused by negligence, and any other obligations imposed by mandatory consumer protection or other applicable laws.
10. Termination
We reserve the right to suspend or terminate your access to the App if you materially breach these Terms. Where possible, we will provide you with reasonable notice and an opportunity to remedy the breach before suspension or termination.
You may delete your account at any time through the App’s settings. Upon account deletion, your cloud-stored account data will be deleted in accordance with our Privacy Policy.
Termination does not affect any rights or obligations that accrued prior to termination, including any payment obligations for services already rendered.
11. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will:
Update the "Effective Date" and "Latest Update" dates at the top of these Terms
Present the updated Terms to you within the App and require your acknowledgment before you may continue using MindCore
If you do not agree with the updated Terms, you may stop using the App and delete your account. Your continued use of MindCore after acknowledging the updated Terms constitutes your acceptance of the changes.
12. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of Portugal.
For EU/EEA consumers: If you are a consumer habitually resident in the EU/EEA, you also benefit from any mandatory provisions of the consumer protection law of your country of residence. Nothing in these Terms affects your right to rely on such mandatory provisions. Any dispute arising from or in connection with these Terms may, at your option, be brought before the courts of your country of habitual residence or the courts of Portugal.
For non-EU users: Any disputes arising from these Terms shall be resolved through the competent courts of Portugal. Before initiating court proceedings, both parties agree to attempt to resolve any dispute through good-faith negotiation for a period of at least 30 days.
You may also be able to use alternative dispute resolution mechanisms offered by national consumer protection bodies in your country of residence.
13. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
14. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and CS TECHNOLOGIES, LDA regarding your use of MindCore and supersede any prior agreements or understandings.
